Purchasing Customer affirms that information submitted in online ordering pertaining to the following are accurate:
Details regarding the deceased, including most importantly height and weight.
Details regarding shipping and the delivery location or receiving funeral home, including address and hours of operation.
Misinformation and mistakes in information pertaining to the preceding items are solely the responsibility of the Purchasing Customer. Purchasing Customer agrees that re-delivery attempts and any charges resulting therefrom are the sole responsibility of the Purchasing Customer, who hereby authorizes 24Hour Caskets to make charges against the Purchasing Customer’s credit card account to satisfy any such additional fees. The minimum fee for re-delivery is $50.
24Hour Caskets and its directors, officers, employees, and representatives are not in any way responsible for damages, of any kind or nature whether direct or indirect, related to any product or service offered for sale on this website.
24Hour Caskets reserves its right to refuse processing and fulfillment for any order for a product that contains errors in pricing or description, regardless of whether such errors derive from 24 Hour Caskets, the Purchasing Customer, or another party.
For all orders from 24 Hour Caskets, the total cash price – including the item(s) price, shipping cost, sales tax, and any additional applicable fees – is immediately due and payable at the time the online ordering form is completed and submitted to 24 Hour Caskets. 24 Hour Caskets maintains a security interest in all products and services it sells, such security interest being maintained until the total cash price and any subsequent fees or charges have been paid in full to 24 Hour Caskets by the Purchasing Customer.
This agreement is binding on the heirs, devisees, administrators, executors, and assigns of Purchasing Customer. Should Purchasing Customer be several in number, all parties are bound by the terms of this agreement and liable to fulfill all obligations arising therefrom. Purchasing Customer affirms that acceptance of this agreement allows 24Hour Caskets to file any claims against the estate of the deceased necessary to remedy any breach of this agreement.
Written consent from 24Hour Caskets is required prior to any assignment of rights under this agreement from the Purchasing Customer to another party. Purchasing Customer agrees that 24Hour Caskets may assign its rights under this agreement to another party and such rights shall remain in full force and effect and be binding upon and inures to the benefit of the successors and assigns of 24Hour Caskets.
Purchasing Customer must report any problems with products within 6 hours of delivery. Purchasing Customer agrees that the actions (or inaction) of their funeral director, funeral home, or any funeral employee in their service are not the responsibility of 24Hour Caskets. Purchasing Customer holds 24Hour Caskets harmless for any failures by these entities. Any damage to products caused by the funeral home or its employees is the sole responsibility of the Purchasing Customer; this includes any failure by the funeral home or its employees to properly shut, lock, or otherwise properly close the casket.
ENTIRE AGREEMENT: All terms agreed to between the Purchasing Customer and 24 Hour Caskets are contained within this agreement. This agreement replaces and supersedes any other agreements between the two parties, written or verbal, relating to the same products and services. Future discussions or agreements cannot change the essential nature of this agreement, unless put down in writing and subsequently signed by the Purchasing Customer and 24 Hour Caskets (or the 24 Hour Caskets assignee).
NOTICE: Any holder of this agreement is subject to all claims and defenses which the debtor could bring against 24Hour Caskets of products or services acquired pursuant hereto. Recovery hereunder by the debtor is limited to amounts up to but not exceeding the amounts paid by the debtor hereunder.
Caskets are purchased as a “type” of merchandise, based on a description of features including gauge of metal or type of wood, materials, color, interior features, and finish. Exact item ordered may be unavailable at time of purchase or requested delivery time; in such rare cases, 24Hour Caskets will provide an equivalent quality product that conforms to the described features.
All charges and fees for shipping and delivery are non-refundable. Saturday shipments may be allowed, for an additional fee: contact the 24Hour Caskets customer service department to inquire regarding availability and costs. We do not offer delivery service on Sundays or major holidays. Special delivery service to specify morning or afternoon delivery, or specific delivery time, is subject to an additional fee. If additional charges cannot be fully anticipated due to individual circumstances, 24Hour Caskets will charge the credit card on file with the Purchasing Customer’s account following delivery for any additional fees that are required.
24 Hour Caskets contracts through a third party provider(s) for shipping and delivery services. 24 Hour Caskets makes every effort to ensure on-time delivery of all orders, however delivery is not in the control of 24 Hour Caskets. Purchasing Customer expressly releases 24 Hour Caskets from any liability for failure of delivery per order specifications. Purchasing Customer agrees that the actions (or inaction) of the delivery service is not the responsibility of 24 Hour Caskets. Purchasing Customer holds Priority Caskets harmless for any failures by the the shipping or delivery company(s); any damage to products caused by the shipping or delivery company(s) or its employees is the sole responsibility of the Purchasing Customer. Damaged products will be held for inspection by the shipping company. Purchasing Customer agrees that in that event, 24Hour Caskets may be unable to provide an identical replacement casket within the same time frame as originally specified; Purchasing Customer further agrees to provide 24Hour Caskets with a reasonable amount of additional time to attempt shipment of a replacement casket, with best efforts made to arrive within the time frame originally specified. This service is provided at no added charge to the Purchasing Customer. Refusal of this service releases 24Hour Caskets from all further liability to provide a replacement casket; ownership of the damaged casket is assumed solely by the Purchasing Customer and 24Hour Caskets is under no further obligation to provide refund, credit, or a replacement.
Delivery refusal of any casket by the funeral home or delivery address incurs an added charge of $750 to the Purchasing Customer. No order cancellations are allowed following order placement and casket shipment. The Purchasing Customer is responsible for acceptance of the casket at the location specified on the order form, whether this is a funeral home or another address provided.
NOTICE: Completion of order form affirms that the Purchasing Customer has read and agrees to all terms and conditions attached to this agreement. Purchasing Customer further agrees, in the event of any claims against 24Hour Caskets, to surrender any and all rights to a court or jury trial and any rights to appeal, and that any claims against 24Hour Caskets shall be resolved via arbitration.
